FIRST KLASS SHIPPING SPECIALIST LIMITED TERMS AND CONDITIONS OF SERVICE

 

 

  1. First Klass Shipping Specialist Limited herein referred to as FKSS is a United Kingdom based door-to-door shipping company from UK to Ghana.

 

  1. By making a pickup order either via phone call, email correspondence, SMS, or delivering a package to our UK warehouse for onward delivery to Ghana, the person entitled to the delivery or the sender authorizes FKSS to pickup, ship, clear, and deliver carriage to the person entitled to the delivery or the sender. The person entitled to the delivery or the sender accepts to abide by these terms and conditions.

 

  1. Delivery ETA provided by FKSS customer service or pickup teams is based on tentative ETAs provided to FKSS by shipping partners and is not a guaranteed delivery date.

 

  1. It is the responsibility of the person entitled to the delivery to provide the accurate name, address, and phone number of the person entitled to the delivery.

 

  1. The sender shall give FKSS a minimum of 24 hours' notice to cancel a scheduled pickup appointment. A charge of £20 may be applied to any customer who cancels a pickup appointment without giving FKSS a minimum of 24 hours' notice.

 

6 . The Customer shall comply with all applicable laws and government regulations of any country to, from, through and over which the goods may be carried, including those relating to the packing, carriage or delivery of goods, and shall furnish such information and attach such documents to the shipment as may be necessary to comply with such laws and regulations. FKSS shall not be liable to the Customer for loss or expense due to the shipper’s failure to comply with the provision.

 

  1. FKSS shall, to the best of its ability, handle and deliver packages close to the form and shape the package was picked up or delivered to be shipped. However, due to mode of transport FKSS does not guarantee the safety of all fragile items it ships and as such items such as glass, mirrors, marble, ceramic, sink, water closet, wall hangings, picture frames, bottles, light and lighting accessories and all other fragile item not stated above are shipped at the person entitled to the delivery or the sender’s own risk.

 

  1. FKSS does not pick up or accept, or ship dangerous goods, including weapons, any banned goods, explosives and ammunition, counterfeit goods, animals, bullion, currency, gemstones, human remains, illegal items such as ivory and narcotics, hazardous materials for international carriage.

 

  1. FKSS shall not be liable for expired or perishable goods.

 

7. Ideally, the weight per package should not exceed 60kg for an overweight or oversized package:

  1. The FKSS pickup team may choose not to pick up the package.

  2. The FKSS pickup team may collect such an overweight or oversized package, but will charge an extra fee for the same standard package material.

  3. The FKSS pickup team may advise the customer to repackage their items into smaller packages for later pickup.

 

8. FKSS shall not be liable for damages caused to a consignment owing to mixing of liquids, including bleach, detergents, soap, oils, fresh milk, and others with food and or other items.

 

9. FKSS pickup team shall not be responsible for packaging and or repackaging of customers' items to be picked up, as all pickup consignments are supposed to be ready for collection before the pickup team arrives at the pickup location. In a situation where the consignment is not ready for collection, the pickup team may have to advise the customer and reschedule her appointment and proceed to the next customer.

 

10. Shipping costs are payable within four days from the pickup date, and the shipping cost paid is not refundable. It is the sole responsibility of customers to make sure their payments are made and acknowledged by FKSS in situations where the booking reference was not used during the payment process.

 

11. FKSS shall be solely liable for packages in the direct custody of its pickup, warehouse team, and delivery teams only, and shall not be liable for packages in containers that are in the custody of its shipping partners or customs control.

 

12. If negligence and fault are identified to be on the part of FKSS leading to damage or loss of the package, FKSS will pay compensation, subject to the submission of evidence of purchase by the sender, which must be between six months of shipment. Where no evidence of purchase or receipt is submitted, any compensation offered shall be at the discretion of FKSS.

 

13. The FKSS delivery team shall not be under any compulsion to unpack or assist recipients to pack packages delivered into the recipient’s storage.

 

14. Taking of overweight or oversized packages upstairs:

  1. The recipient or sender of an overweight or oversized package shall make adequate arrangements for others to assist our delivery team to take packages overweight or oversized packages upstairs, or explore other options that may be agreed upon between the recipient and our delivery team for the safe delivery of the content of such packages.

  2. FKSS delivery personnel shall not be under any compulsion to carry overweight or oversized packages upstairs or flight of stairs, or into a storage area.

  3. FKSS shall not be liable for any damage resulting from taking an overweight or oversized package upstairs or into a storage area.

 

15. If a delivery of a package is found to have been delayed beyond the ETA provided by our customer service and pickup teams and investigations establish that the issue is within the control of FKSS (e.g., delivery issues, automobile breakdown, etc), FKSS will notify affected recipient and arrange delivery as early as possible, but will not pay compensation to the affected customer.

 

16. If a delivery of a package is found to have been delayed beyond the ETA provided by our customer service and pickup teams and investigations establish that the issue was outside the control of FKSS but involves shipping carriers, adverse weather conditions, supply chain disruptions, customs clearance issues, incorrect or incomplete shipping information provided by the customer;

  1. FKSS will notify affected customers via email within 24 hours of receiving the information from our partners

  2. FKSS will not be liable for any direct or indirect losses (e.g., loss of profits, inconvenience, etc.) and will not offer compensation to affected customers.

 

17. FKSS shall not be liable for scratches or damages caused to a fridge, TV, washing machine, dishwasher, sofa, fittings and fixtures, furniture that:

  1. Does not include the original manufacturer's packaging for shipping.

  2. Has not been properly packaged, wrapped, cushioned, or protected for shipping by sea and land.

 

  1. FKSS shall not be liable for damages to the screen or any part of a used or new TV for which there is no visible sign of cut or impact on the exterior of the TV box corresponding to the reported damage, and shall not be liable for damages to the screen or any part of a used or new TV that is found to have other foreign items (cloth, tin, metallic products, etc) within the TV box.

19. If a recipient declines to accept the goods or the sender requests shipment to be returned to the UK, FKSS shall assist the sender to return the shipment to the UK at the sender’s own cost.

20. If a consignment that is received at our Ghana warehouse is found to be unpaid, unwanted, refused, or uncollected, one week after it arrives;

  1. A daily storage fee of between £5 and £20 may be applied.

  2. FKSS will notify the customer via WhatsApp, sms, or email to request payment for delivery to be arranged.

  3. If payment is not received, FKSS will send a Disposal Notice to the customer.

  4. If payment is not received, FKSS  will take all necessary actions to recover space occupied by unpaid packages and eliminate the cost associated with the storage of such packages, including either donating the package to charity or auctioning it to recover part of the shipping cost.

 

21. At the point of delivery, the person entitled to the delivery or the sender, before taking the package into his/her custody, shall check the condition of the package delivered and raise any complaints about the package in the presence of the our delivery team, sign the delivery note to confirm receipt of the package - unless otherwise stated, goods received and signed for on the shall be deemed as delivered in good condition. In the event of significant or visible damage to packages, the person entitled to the delivery or the sender of the items must:

  1. First, notify the FKSS official who made the delivery within 24 hours.

  2. Second, the person entitled to the delivery or the sender should ensure that the reported package is kept intact in the state as reported.

  3. Receipts, invoices, and correspondence related to the reported damaged items should be made ready, as such may be required by the FKSS office to deal with reported damages.

  4. The request for damage claim must be accompanied by a list of shipments that were originally declared to FKSS, in the original packaging. This must be made available to the Manager in the Ghana office for inspection at the time of making the complaint.

  5. The person entitled to the delivery or the sender should make a complaint to FKSS in writing within 3 days from receipt of the goods.

  6. FKSS shall not accept photos or videos of damage to a package or loss of content of a package taken in the absence of an FKSS representative.

  7. FKSS shall not be liable for any damage captured in a photo or video taken in the absence of our Delivery Personnel at the point of delivery of that consignment.

  8. FKSS shall respond to all queries reported within 21 working days after investigations have been made.

  9. FKSS reserves the right to reject claims made without following due process.

 

22. FKSS does not check the details, quantities or descriptions of the content of a customer's package including boxes, wrapped items, suitcases, barrels, pallets, etc, and all queries about quantities and descriptions of the content of any such package delivered should be directed to the person entitled to the delivery or the supplier.

 

23. FKSS shall not be liable for any loss or issues of reduced level, quantity, or count of the content of a package that has been delivered in its original packaging or in the exact or close to the form and shape it was picked up or delivered to be shipped as was picked up.

 

24. FKSS  may update any part of these terms and conditions without prior notice to customers.
